Debt Collection Agency Sued
(June 2, 2010) - A debt collection agency based out of Pennsylvania had the tables turned on them this week when Allen Jones of Texas sued them and received $1.5 Million as a result of harassing, derogatory phone calls. ACT debt collectors confessed to logging eight expletive-filled calls to Jones, of Lewisville, Texas, in August 2007, many peppered with the "n-word." Jones, 26, saved the vulgar voice mails as evidence.
"This is your motherf------ wake-up call you little lazy a-- b----," a collector said in one early-morning. "Get your motherf------ n----r ass up and go pick some motherf------ cotton fields."The calls from the Pennsylvania-based company came as early as 6:30 a.m. and as late as 11 p.m., seeking to collect a $200 debt from Jones.
He said he told ACT in their first communication that he had already paid the bill.
"This shouldn't be tolerated," Jones told WFAA. "Nobody should have to experience what I had to experience."
A jury agreed with Jones, finding that ACT violated debt collection ethical guidelines. Jones was awarded $1.5 million in punitive damages, $143,000 in attorney's fees and $50,000 in mental anguish, one of the largest rewards of its kind.
One of Jones' attorneys, Dean Malone, said the reward was fair punishment for "the most egregious collection case" he's ever seen.
"It was just significant, over-the-top harassment," he told ABC News. "I've handled hundreds of these cases over the years. This is by far the worst I've ever seen."
A lawyer for ACT told ABC that the language used in the calls was "indefensible" and said the calls "must have been in some sort of personal attack unrelated to the business."
George Vignola, a collection expert and president of Commercial Collection Consultants, a debt collection firm based in Massapequa, N.Y., told AOL News he was shocked after listening to the audio of the voice mails.
"As an agency owner, I couldn't believe the vulgarity. That's what gives our industry a bad name," Vignola said. "What could you possibly hope to achieve by using profanity? The only thing you're going to get is a dial tone."

iPhone Verizon Release 06-02-2010 June 2, 2010
Yesterday, Steve Jobs, Apple CEO, gave a rare interview during D8 conference. There was hope that he would provide some insight as to whether Verizon would begin to carry iPhones anytime the near future, however; his only clue to that possibility was his response "there may be" when asked whether there would be a good business objective to allowing other U.S. carriers to sell the iPhone. When asked if the iPhone would be sold by any other U.S. carriers in the near future, his response was "no comment".
There are many rumors pointing that Verizon iPhone is not going to be launched during the next week conference. However, there was one report in the thestreet.com that Apple and Verizon are negotiating to launch a new iPhone in December. However, no company has provided any confirmation on this report.
Apple is most likely launch its new iPhone 4G in the next week’s Worldwide Developers conference. The new iPhone will once again be offered with AT&T as the company has already held off vacation of many of its workers for the months June and July.

Antidepressant Use Rises
A new survey by Consumer Reports concludes that antidepressants are the preferred method to dealing with depression in the United States while the use of psychotherapy to deal with depression dropped from 32% to 19%. Columbia University researchers report that around 27 million Americans, ages 6 and up, were using antidepressants by 2005: "Several factors may have contributed to this trend, including a broadening in concepts of need for mental health treatment, campaigns to promote mental health care and growing public acceptance of mental health treatments.... In parallel with growth in mental health service usage, psychotropic medications have become increasingly prominent in treatment."While the common recommendation for treatment of depression is a combination of therapy and medication, only 1 out of 5 seek the recommended form of help.
There has been an enormous marketing push by the pharmaceutical companies which researchers are saying is responsible for the dramatic use of antidepressants. Cymbalta and Pristique alone accounted for 300 million dollars in marketing campaigns in 2009. Cymbalta and Pristique are the 2 most common known antidepressants amount households, even if the household is not using the medication.
